The terms and conditions governing your use of BarJobs

1. Acceptance of Terms

Welcome to BarJobs, LLC ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BarJobs website, platform, and related services (collectively, the "Platform").

By accessing or using BarJobs, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Accounts

Eligibility

You must be at least 18 years old to use BarJobs. By using the Platform, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will provide accurate, current, and complete information when posting listings or applying to jobs

Account Responsibility (Employers)

If you create an account to post job listings:

  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to notify us immediately of any unauthorized use of your account at support@barjobs.io
  • You are responsible for all activities that occur under your account
  • BarJobs is not liable for any loss or damage arising from your failure to protect your account information

No Account Required (Job Seekers)

Job seekers can browse and apply to jobs without creating an account. When applying, you provide contact information directly to employers.

3. Listings, Billing & Refunds

Listing Plans

BarJobs offers pay-per-posting plans for job listings:

  • Standard Job Posts: $49 for 30 days
  • Featured Job Posts: $75 for 45 days with premium placement

Billing

  • One-Time Purchase: All listings are one-time purchases. There are no subscriptions or recurring charges
  • Payment Processing: All payments are processed securely by Stripe. You authorize us to charge your payment method at checkout
  • Instant Activation: Listings go live immediately after payment is confirmed

Editing Listings

After payment, you receive a confirmation email with a special link to edit your listing while it is active. You may update job details, requirements, and contact information at any time.

Refunds

  • All Sales Are Final: Because listings are activated immediately and provide instant exposure, we generally do not offer refunds
  • Technical Issues: If you experience technical problems that prevent your listing from appearing, contact support@barjobs.io and we will resolve the issue or provide a refund
  • Required by Law: Refund policies comply with applicable consumer protection laws

4. Acceptable Use

You agree to use BarJobs in compliance with all applicable laws and these Terms. You will NOT:

  • Post false, misleading, or fraudulent job listings
  • Use the Platform for any unlawful purpose, including employment discrimination
  • Post listings that violate labor laws, offer illegal compensation, or misrepresent job conditions
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Upload, transmit, or share content that is offensive, defamatory, obscene, or violates others' rights
  • Collect or harvest personal information of job seekers for purposes unrelated to employment
  • Use automated tools (bots, scrapers, scripts) to access or extract data from the Platform without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Interfere with or disrupt the integrity or performance of the Platform
  • Use the Platform to send spam, phishing, or unsolicited communications

Consequences of Violation: We reserve the right to remove listings, suspend or terminate your access, and pursue legal action if you violate these Terms.

5. User-Generated Content

Employer Content

By posting job listings on BarJobs, you grant us a worldwide, royalty-free, non-exclusive license to display, reproduce, and distribute that content on our Platform to facilitate job matching. You retain ownership of your content.

Job Seeker Content

When you apply to jobs through BarJobs, your application materials (name, contact information, resume, cover letter) are shared directly with the employer. Employers are responsible for how they handle applicant data.

Content Representations

You represent and warrant that:

  • You own or have the necessary rights to the content you submit
  • Your content is accurate and does not misrepresent the job or your qualifications
  • Your content does not violate any third-party rights or applicable laws

We may remove content that violates these Terms or is otherwise objectionable.

6. Intellectual Property

Our Content

All content, features, functionality, and materials on the Platform (including text, graphics, logos, software, and user interface) are owned by BarJobs, LLC or our licensors and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Platform
  • Create derivative works based on the Platform
  • Use our trademarks, logos, or branding without written permission

7. Third-Party Services

The Platform integrates with third-party services (e.g., payment processors, analytics). Your use of these services is subject to their respective terms and privacy policies.

  • No Endorsement: We do not endorse or assume responsibility for third-party services
  • External Links: Job listings may contain links to employer websites. We are not responsible for the content, accuracy, or practices of external sites
  • Service Availability: Third-party services may change or become unavailable. We are not liable for disruptions caused by third-party providers

8. SMS/Text Messaging Terms

BarJobs SMS Program

BarJobs provides optional SMS services including job application alerts for employers, application status updates for job seekers, and account verification codes for all users. By opting in to receive text messages from BarJobs, you agree to the following terms:

Program Description

BarJobs SMS services include notifications to employers when new job applications are submitted, status updates to job seekers about their applications, and one-time verification codes for account security. These messages are delivered through our SMS providers, Twilio and Bird.

Message Frequency

Message frequency varies based on job application activity. You will receive one text message per job application submitted to your listings. The number of messages depends on how many applications you receive.

Message & Data Rates

Message and data rates may apply. Please check with your mobile carrier for details about your text messaging plan.

Opt-Out Instructions

You can opt out of BarJobs Job Alerts at any time by replying STOP to any message. After opting out, you will receive a confirmation message and will no longer receive text messages from BarJobs. You can also manage your SMS preferences in your account settings or by contacting support@barjobs.io.

Carrier Liability

Carriers (e.g., Verizon, AT&T, T-Mobile) are not liable for delayed or undelivered messages. Message delivery is subject to network conditions and carrier policies.

Privacy

Your phone number and SMS consent information are protected under our Privacy Policy. Our SMS service providers (Twilio and Bird) process messages solely for delivery purposes. We do not sell or share your phone number or opt-in data with third parties for marketing purposes.

9. Disclaimers & Limitation of Liability

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

BarJobs does not guarantee that:

  • The Platform will be uninterrupted, secure, or error-free
  • Job listings or employer information is accurate, complete, or current
  • Use of the Platform will result in employment or successful hiring
  • Employers or job seekers will respond to inquiries or applications

BarJobs is a job board platform that connects job seekers with employers. We do not verify employers, guarantee job conditions, or participate in the hiring process.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BARJOBS, LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

This includes but is not limited to:

  • Loss of profits, revenue, data, or business opportunities
  • Employment disputes, wrongful termination, or discrimination claims
  • Issues arising from employer-employee relationships
  • Third-party service failures or data breaches

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO BARJOBS IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability for certain damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless BarJobs, LLC, its affiliates, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Job listings you post or applications you submit
  • Your violation of any third-party rights, including employment, intellectual property, privacy, or publicity rights
  • Any employment relationship or dispute arising from use of the Platform

11. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of California and the United States, without regard to conflict of law principles.

Jurisdiction & Venue: Any disputes arising out of or related to these Terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Marin County, California, and you consent to personal jurisdiction in those courts.

12. Termination

Our Right to Terminate

We reserve the right to remove listings, suspend or terminate your access to the Platform at our sole discretion, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Posting fraudulent or misleading listings
  • Fraudulent or illegal activity
  • Abuse of other users or the Platform

Effects of Termination

Upon termination:

  • Your right to access and use the Platform immediately ceases
  • Active listings may be removed without refund
  • Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability, indemnification) will continue to apply

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Post a notice on the Platform for significant changes

Your continued use of BarJobs after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.

14. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BarJobs, LLC regarding your use of the Platform and supersede all prior agreements or understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations at any time without notice.

Force Majeure

BarJobs, LLC is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
